PTA Sets Strict Licensing Rules for 5G Operators in Pakistan

The Pakistan Telecommunication Authority (PTA) has outlined comprehensive licensing obligations for next-generation mobile services in its recently issued Information Memorandum. These rules will form a binding part of the licensing framework for companies seeking 5G spectrum in Pakistan.

According to the document, successful bidders will be required to provide emergency services, comply with lawful interception requirements, and ensure non-discriminatory access for all users. License holders must maintain high standards of service quality, availability, and reliability, while fully meeting national security requirements. Regulators will also have the authority to inspect radio and network equipment when required.

The Information Memorandum introduces strict pricing and consumer protection measures. Operators must comply with the Telecom Consumer Protection Regulations 2009, ensure fair pricing, and avoid anti-competitive practices. They will also be obligated to provide detailed billing information to consumers upon request.

PTA has retained the power to regulate tariffs, terms, and conditions in markets where an operator holds Significant Market Power. In such cases, operators may be required to seek prior approval from the regulator before implementing any changes to tariffs.

In addition, license holders must comply with data protection and privacy laws, safeguard the confidentiality of communications, and adhere to regulations governing spam, unsolicited messages, and fraudulent communications. Operators will also be required to publish updated coverage maps on their websites, clearly indicating service areas and the technologies being offered, including both 4G and 5G services.

The licensing framework further obligates operators to support local manufacturing of mobile phones and telecom equipment. Companies must also ensure site clearance in accordance with PTA and Frequency Allocation Board (FAB) procedures and submit performance bank guarantees to secure rollout commitments.

PTA has emphasized that all quality-of-service standards, along with any future performance indicators introduced by the regulator, will remain mandatory throughout the entire license period.
